What options are there for recording a phone call?
Record directly with your smartphone
Most smartphones have a built-in function for recording calls. Check your device’s settings to make sure this function is activated.
Recording app
There are many applications in the App Store or on Google Play that have been specifically developed for recording phone calls. The so-called recording apps must be installed on the smartphone before you can use them to record phone calls. Examples of recording apps include the Automatic Call Recorder, the Call Recorder – ACE, the Cube Call Recorder or the Compliance Recorder.
External devices
In addition to recording apps, there are also external devices that have been developed for recording calls. These devices must be connected to the phone before you can use them to record calls.
Please note the legal situation. Recording telephone conversations without the consent of all parties involved is illegal in many countries. Check the laws in your location before recording a conversation so that you are not committing a crime.
Who is allowed to record telephone conversations?
It is common practice. In many areas of life, you are informed before a conversation on the phone that the conversation is being recorded. If you record a telephone conversation without authorization, you can be prosecuted under Section 201 Paragraph 1 of the Criminal Code (StGB). This regulation protects the confidentiality of the word. It is not only forbidden to record a telephone conversation. You are also committing a crime if you distribute this recording publicly. Attention! This is not just about telephone conversations. For example, if you eavesdrop on a colleague and record their conversation on their cell phone, the public prosecutor will also be interested in it. But what laws are there for call recording and when are recordings of calls permitted?
Legally permitted
In exceptional cases, legal permission standards can allow the recording of telephone calls. One example is the recording of emergency calls via the numbers 110 and 112, which is permitted under state law. The responsible authorities can also monitor and record conversations as part of criminal investigations. The hurdles for this are high, however, and require the suspicion of a serious crime.
Consent required
In other cases that are not emergencies or crimes, the consent of the person concerned is usually required. The requirements for effective consent are varied. First of all, consent must be obtained before recording. In fact, it must be declared in writing by the person being contacted. In practice, however, verbal consent or input via the telephone keypad is usually considered sufficient for purely telephone contact. The person being contacted must also be informed about the type and method of data processing and must give their consent voluntarily.
Who has to record a telephone call?
Whether someone is obliged to record telephone conversations depends on the laws and regulations of the respective country.
n Germany, certain companies must record telephone conversations in accordance with the General Data Protection Regulation (GDPR) and the Telecommunications Act (TKG):
Financial service providers: Since the updated FinVermV, in addition to banks, liability umbrellas and asset managers with a BaFin license under Section 32 of the Banking Act (KWG), financial investment intermediaries with a license under Section 34 of the Trade Regulations (GewO) are also obliged to record telephone or video consultations and store them in an audit-proof manner for 5 or 10 years.
Customer service: Companies that offer customer service may be required to record telephone conversations in order to improve their services and deal with customer complaints effectively.
Regulated industries: In some regulated industries, such as telecommunications, certain telephone conversations may have to be recorded in order to meet applicable regulatory requirements.
It is important to note that recording telephone conversations is also subject to data protection requirements. The recorded data may only be used for the specified purposes and must be kept securely. Violations of applicable laws and regulations can lead to legal consequences.
